ANJANA MISHRA ORAL ORDER 30-07-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are in custody since 28.11.2017 in connection with Madhubani Town P.S. Case No. 302 of 2017 registered for the offences punishable under Sections 379 of the Indian Penal Code.
Learned counsel for the petitioners submits that they were arrested in connection with Madhubani Town P.S. Case No. 315 of 2017 on suspicion and thereafter they were made to give a self-confessional statement before the police which has no evidentiary value. It is further submitted that thereafter the petitioners were remanded in connection with several other cases
Patna High Court Cr.Misc. No.43068 of 2018 (3) dt.30-07-2018 2/2 including the present case and have been languishing in jail. Learned counsel for the petitioners submits that though nothing has been recovered from their possession and the petitioners No. 1 and 2 are students and petitioner No. 3 is a farmer and they have not been placed on T.I. Parade.
Considering the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No. 302 of 2017.
