2. The petitioner apprehends his arrest in connection with Raniganj P.S. Case No. 515 of 2024, registered for the offences punishable under Sections 96, 352, 3(5) of the BNS, 2023 and Section 12 of POCSO Act.

3. As per allegation, the petitioner along with other coaccused persons have kidnapped the informant's minor daughter for the purpose of marriage.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.42635 of 2025(5) dt.24-12-2025 2/2 present case. He has further submitted that statement of the victim was recorded under Section 183 of the BNSS which does not fully corroborate the recitals of the FIR. His further submission is that the age of the victim according to the medical examination report is 20-22 years and no any kind of injury was found on the person of the victim.

5. Learned counsel for the informant as well as State opposed the prayer for anticipatory bail of the petitioner by submitting that according to the Bihar School Examination Board certificate, the date of birth of the victim is 10.08.2009 and at the time of occurrence, she was aged about 15 years.

6. Considering the above-mentioned facts and circumstances, in my view, the petitioner does not deserve the privilege of anticipatory bail. Accordingly, it is rejected.

7. The petitioner is directed to surrender in the Court below and seek regular bail. If he does so, his regular bail application shall be considered on its own merit without being prejudice by this order.
