The petitioner is languishing in custody for the offences punishable under Sections 411/413/414/34 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. According to FIR, from the possession of the petitioner one loaded country-made pistol was recovered. Petitioner is in custody since 04.05.2017.
Submission is that the petitioner has disclosed his criminal antecedent in para-3 of the bail petition and all those cases are against unknown. The petitioner was remanded in those cases on the basis of confession obtained by the police, in the present case, of co-accused Bhim Sahani.
Patna High Court Cr.Misc. No.29432 of 2018 (4) dt.30-07-2018 P2/ Considering the nature of allegation and the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Vaishali (Belsar O.P.) P.S. Case No.112 of 2017, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
