29-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Brahmpura P.S. Case No. 427 of 2019, registered for the offence under Section 272, 273, 290 of the I.P.C. and Section 30(a)(d)(e)(F), 41 of Bihar Prohibition and Excise Act.

2420 liters of foreign liquor has been recovered from a truck, which is alleged to be brought by this petitioner, as per the disclosure made by co-accused, who was apprehended on spot.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the truck in question.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Muzaffarpur in connection with Brahmpura P.S. Case No. 427 of 2019.
