JUSTICE BIRENDRA KUMAR ORAL ORDER 30-07-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody in connection with Raffiganj P.S. Case No.31 of 2018, a case under Sections 147/148/149/341/323/307/504 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioners are in custody since 28.02.2018. Allegation is that petitioner Sunil Yadav assaulted with Garasa. Petitioner Baiju Yadav assaulted with Bhala and petitioner Lalmohan Yadav caused fire-arm injury at the forehead of Harkhu Yadav.

Submission of the learned counsel for the petitioners

Patna High Court Cr.Misc. No.30686 of 2018 (5) dt.30-07-2018 P2/ is that the doctor has found simple injury on the person of injured Brijesh Yadav, Rita Devi and Rajesh Yadav. However, fire-arm injury was found on the person of Harkhu Yadav. Considering the nature of allegation and the period already undergone, let the petitioners, namely, Sunil Yadav, Baikunth Yadav and Baiju Yadav, be released at once on bail and petitioner Lalmohan Yadav be released on bail after completion of ten months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Raffiganj Police Station Case No. 31 of 2018, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
