This application, for grant of regular bail, arises out of Raghopur Police Station (Rustampur O.P.) Case No. 110 of 2020, disclosing offences under Sections 304(B) an d 201/34 of the Indian Penal Code.
The allegation, as per the First Information Report is that the daughter of the informant was married to co-accused Shailesh Rai about three years back and thereafter the petitioner along with other accused persons started demanding pulsar motorcycle and gold chain from the daughter of the informant and her family members and due to non-fulfillment of the demand, all the accused persons killed the daughter of the

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to oblique motive. Learned counsel further submits that the petitioner is neither family member of the husband of the deceased nor he is concerned with the allegation of demand of dowry. Learned counsel next submits that the fact of the matter is that the father of the petitioner was killed by the side of the informant for which Raghopur P.S. Case No.68 of 2019 was registered on the basis of his ferdbeyan and due to this, he has falsely been implicated in this case. Learned counsel next submits that the petitioner is in custody since 14.08.2020.
Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that the petitioner is not the family member of the husband of the deceased and he is in custody since 14.08.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, Guddu Kumar, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IX,
