JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Trial No. 05 of 2016 arising out of Hathouri P.S. Case No. 96 of 2015 registered under Section 366A of the Indian Penal Code. The petitioner is said to have kidnapped the sister of the informant for the purpose of marriage. The impugned order also indicates that she has been subjected to sexual intercourse by the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case due to dirty village politics. He has got no criminal antecedent. He has been languishing in custody since 01.09.2015 Considering the nature of allegation made against

Patna High Court Cr.Misc. No.34037 of 2017 (2) dt.20-07-2017 2/2 the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer for bail of the petitioner is rejected. Learned lower court is directed to dispose of the case as expeditiously as possible within six months from the date of receipt or production of a copy of this order.
