2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1) and 238 of the BNS (Corresponding to Section 302 of the Indian Penal Code).
3. The case of the prosecution is that the wife and daughter of the informant have gone to pluck flowers for worshiping, but they did not return home after considerable time. They were being searched. On searching, the son of the informant found the dead body of his mother and sister near Uchit Singh Primary School. Accordingly, the FIR was lodged against unknown miscreants.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.44286 of 2025(2) dt.11-07-2025 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. It is also submitted that the name of this petitioner has been surfaced in the confessional statement. It is alleged that the petitioner was having illicit relation and that he has committed this offence in association with one Rahul. There are some calls with the deceased and the petitioner was on talking terms with the deceased. It is next submitted that except the call details which goes to show that the petitioner was on talking terms with the deceased and nothing is there in the confessional statement against him. Earlier the petitioner bail petition has been rejected by this Court vide order dated 11.02.2025, passed in Cr. Misc. No.
87365 of 2024, with a liberty to renew his prayer for bail after three months. Learned counsel for the petitioner has further submitted that from that date, the petitioner has spent more than three months in incarceration. Moreover, the petitioner is languishing in judicial custody since 19.08.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is

The above named petitioner is directed to be released on bail in connection with Saharsa Sadar P.S. Case No. 848 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa.
