The petitioner is in custody in connection with Fulkaha P.S. Case No. 24 of 2019 for the offence under Sections 420, 413 and 414 of the Indian Penal Code.

Allegation against the petitioner is that on raid, the police found several persons were present in the house of the petitioner and several motorcycles, accessories along with two tractors were found kept concealed in the room of the petitioner. The petitioner is in custody since 15.02.2019. Learned counsel submits that in connection with the same raid, the police has also registered Fulkaha P.S. Case No. 25 of 2019 under Section 30(A) of the Bihar Prohibition and Excise Act, 2016. He further submits that after investigation, the police has submitted charge-sheet.

Considering the fact that prior to the incident dated 09.02.2019, there was no criminal antecedent of the petitioner and also the fact that the police after investigation submitted

Patna High Court CR. MISC. No.40823 of 2019(2) dt.02-07-2019 2/2 charge-sheet, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Fulkaha P.S. Case No. 24 of 2019.
