The petitioner seeks bail in anticipation of his arrest in connection with Suryagarha P.S. Case No. 37/2020 instituted for the offences under Sections 30(a)/41 of the Indian Penal Code.

It has been submitted by learned counsel for the petitioner that though there is recovery of 941.769 litres of liquor from the pick-up van belonging to the petitioner but the petitioner had given the vehicle on contract for three months to one Mr. Jaijai Ram. There was clear instruction to Mr. Jaijai Ram not to use the vehicle for any unauthorized

Considering the aforesaid facts and taking into account the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge -II-cum-Special Judge, Excise, Lakhisarai in connection with Suryagarha P.S. Case No. 37/2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
