2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 81 litres of illicit country made liquor has been recovered from a tempo.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Petitioner is not named in the FIR and name of petitioner transpired in this case during investigation. Nothing incriminating has been recovered from the conscious possession of the petitioner.

5. Learned APP for the State has opposed the bail petition.

6. Considering the quantity of recovery and the fact that petitioner is registered owner of the tempo from which the said recovery has been effected, the prayer for anticipatory bail of the petitioner is rejected.
