Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sabour P.S. Case No. 103 of 2020, lodged under Sections 147, 148, 149, 323, 504, 506, 307, 354(B) of the Indian Penal Code.

As per prosecution, the present case has been filed with allegation that accused persons have put pressure for withdrawal of Case No.359 of 2018, for which the informant was not ready, upon which total 20 persons reached in a group at the house of informant and initially created pressure and

No.42644 of 2022(2) dt.06-12-2022 2/3 subsequently started assaulting by iron rod and lathi upon the informant and other members of family, thereafter this case has been lodged under different sections of I.P.C. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is only a member of mob, all the allegations are general and omnibus. He also submits that there are series of accused persons who have been granted anticipatory bail by orders passed by Co-ordinate Bench of this Court which are annexed as Annexure Nos.4, 5 & 6 of this application. Learned counsel for the petitioner further submits that petitioner is in custody since 24.02.2022, charge sheet has already been filed and antecedent of petitioner is clean.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case

Patna High Court CR. MISC. No.42644 of 2022(2) dt.06-12-2022 3/3 No. 103 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
