====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 09-11-2016 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are seeking bail in connection with Pasraha P.S. Case No. 109 of 2016 registered for offences under sections 147, 149, 427, 307, 385 of the Indian Penal Code and Section 27 of the Arms Act.
An allegation has been made that on 24.8.2016, the Informant was on ride on his private vehicle along with Jyotish Singh and driver Binod Sah and when they reached towards south of village Piparpanti, 10 to 12 persons including petitioners surrounded the vehicle and all the persons exhorted to kill the
Patna High Court Cr.Misc. No.45754 of 2016 (3) dt.09-11-2016 Informant whereupon co-accused Shailendra Yadav fired which hit the driver Binod Sah. The petitioners are in jail custody since 15.9.2016.
Learned counsel for the petitioners has annexed copy of the injury report which shows that the injury was caused due to hard and blunt substance.
Looking to the entire facts and circumstances of the case, let the petitioners, namely, Rabin Yadav, Bipin Yadav and Ghanshyam Yadav, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Pasraha P.S. Case No. 109 of 2016.
