This application is for grant of regular bail in connection with Giriyak P.S.Case No.105 of 2017, for the offences punishable under Sections 30/32 of the Excise Act, 2016. Allegation against the petitioner is of recovery of 20 ltrs. of country-made liquor.
Submission of the learned counsel for the petitioner is that he was not arrested on the spot rather his motorcycle was recovered from that place. Further submission is that he has been made accused in two other cases of similar type but he is on bail in those cases and he is in custody for about two months. Heard learned A.P.P. also.
Having heard both sides and in view of allegation as
Patna High Court Cr.Misc. No.34828 of 2017 (2) dt.03-08-2017 2/2 well as criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to conduct the trial on day-to-day basis and try to conclude it within a period of four months and if not concluded, the petitioner is at liberty to renew his prayer for bail bond before the court concerned.
With the aforesaid observation, this application is dismissed.
