2. The petitioner apprehends his arrest in a complaint case punishable for the offence under Section 354(B) of the Indian Penal Code and Section 67(A) of the I.T. Act.

3. The complaint case, in brief, is that the petitioner used to send vulgar messages to the victim and transmit vulgar photos of victim on internet. He also used to make call to the victim's husband saying that he loved the victim and as to why he got married with her. It is further alleged that on 31.12.2022, a Panchayati was held between the parties, in which the petitioner assured that he would not transmit pictures of victim on whatsapp and Facebook, but from 16.05.2023 to 05.06.2023, the petitioner again sent filthy messages to the victim and threatened to ruin her life.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. However, by filing supplementary affidavit, petitioner undertakes that he will never repeat such type of offence in future. Petitioner claims clean antecedent.

5. Learned A.P.P. for State opposes the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as undertaking given by the petitioner, his prayer for anticipatory bail is allowed.

7. Accordingly, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Complaint Case No. 943 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
