2. Petitioner seeks regular bail in connection with Motihari Muffasil P. S. Case No. 445/2023 in a case registered for the offences punishable under Sections 420, 467, 468, 471/34 of the Indian Penal Code.
3. As per prosecution case, co-accused Dharmendra Mishra, in connivance with other F.I.R. named accused persons, fraudulently sold the land of this informant to one Upendra Kumar.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, petitioner himself is a victim as co-accused Dharmendra

No.42662 of 2025(2) dt.08-08-2025 2/2 Mishra who executed a registered 'agreement to sale' on 24.03.2023 in favour of petitioner and co-accused Shree Kant Mishra and took Rs. 1,49,000/- as token amount out of total consideration amount of Rs. 5,49,000/- but later on, refused to register the land in question in their favour. Petitioner stood as witness against deed no. 10349 dated 19.06.2023 executed by co-accused Dharmendra Kumar in favour of Upendra Kumar. Moreover, dispute involved in this case is purely civil in nature. Petitioner is in custody since 09.04.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Muffasil P. S. Case No. 445/2023.
