The petitioner apprehends his arrest in connection with POCSO Case No. 37 of 2019, arising out of Fatehpur P.S. Case no. 89 of 2019, registered under Sections 341 and 354 of the Indian Penal Code and Section 8 of the POCSO Act. The accusation is that on 31.03.2019 at 7.00 A.M. informant was going to call her mother in the meanwhile, when she reached near Gaushala, her villager Rahul Kumar @ Dharmendra (Petitioner) caught hold her hand and tried to drag her in the Gaushala, but, anyhow, she managed to escape from there and narrated the incident to her parents. Learned counsel for the petitioner submits that petitioner is the pattidar of the informant and due to land

Patna High Court CR. MISC. No.41245 of 2019(2) dt.05-07-2019 2/2 dispute, the parents of the informant got managed to implicate the petitioner. Moreover, the petitioner, who is 24 years has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J-I-cum-Special Judge, POCSO, Act, Gaya in connection with Fatehpur P.S. Case No. 89 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
