The petitioners seek bail in anticipation of their arrest in connection with Daraunda P.S. Case No. 220 of 2020 dated 10.08.2020 instituted for the offences under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.

The accusation against the petitioners is of

Patna High Court CR. MISC. No.3637 of 2021(2) dt.26-08-2021 2/3 having assaulted the informant. The petitioner no. 1 is Ajay Kumar Singh, who is son of Late Ramayan Singh. There is another accused person with the same name, who is the son of Mahendra Singh. The son of the informant is said to have been assaulted by Ajay Kumar Singh, son of Mahendra Singh. Though aforesaid Ajay Kumar Singh, son of Mahendra Singh is said to have assaulted the son of the informant by means of a farsa but he has received grievous injury by hard and blunt substance.

Considering this aspect of the matter, Ajay Kumar Singh, son of Mahendra Singh has been granted anticipatory bail by a Bench of this Court.

The petitioners though are named in the FIR and are also alleged to have participated in the occurrence but they are not the authors of any injury. The victim has received only one injury.

Regard being had to the aforestated facts and taking into account that the parties are agnates, they are

No.3637 of 2021(2) dt.26-08-2021 3/3 directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Siwan in connection with Daraunda P.S. Case No. 220 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
