JUSTICE SATYAVRAT VERMA ORAL ORDER 09-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in connection with Dumraon P.S. Case No. 123 of 2021 instituted for the offences under Section 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 30.06.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of committing theft of motorcycle of the informant from Shiv Temple.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and the alleged motorcycle was recovered from some other place and
Patna High Court CR. MISC. No.52309 of 2021(2) dt.09-02-2022 2/2 based on the information provided by the police spy, the petitioner came to be implicated.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 30.06.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 123 of 2021 with a condition that one of the bailor shall be the father of the petitioner (Jitendra Yadav). (Satyavrat Verma, J) Rishi/- U T
