====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending her arrest in connection with a case registered for the offence under Sections 376, 493/34 of the Indian Penal Code. She is named in the First Information Report along with her son, Accused no.1, Md. Uddam and her husband Md. Atabul. Informant has stated in her written report dated 18.06.2015 that Accused no.1, son of the petitioner forcibly established physical relationship with her 3-4 months earlier on the pretext that he will get married to her and when son of the petitioner refused to marry her, villagers were informed and panchayati was held on several dates and finally on 07.06.2015, but Accused no.1 refused to even accept the verdict of panchayati, present case was filed.
Patna High Court Cr.Misc. No.41480 of 2015 (2) dt.16-10-2015 2/2 It appears that the informant is the daughter of the domestic help serving in the house of the petitioner. In such, circumstances, the fact that petitioner was not aware about the conduct of her son is not to be believed.
In the circumstances, prayer of the petitioner for grant of bail in the event of arrest is rejected with direction to surrender in the court of S.D.J.M., Araria in connection with Araria Mahila P.S. Case No. 25 of 2015 within four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail, which should be considered in accordance with law.
