JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Forbesganj P.S. Case no. 113 of 2017, registered for the offence under Sections 379, 411 of the Indian Penal Code. The case of the prosecution is that according to the informant his motorcycle was stolen by unknown persons. It is said that the F.I.R. has been lodged against unknown persons. The petitioner is said to have been apprehended and subsequently been made an accused in the present case.

The learned counsel for the petitioner submits that no recovery has been made from his possession and in fact the recovery of the said motorcycle was made from someone else namely Md. IIliyas. The petitioner is in custody since 24.04.2017.

Patna High Court Cr.Misc. No.33736 of 2017 (2) dt.20-07-2017 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Forbesganj P.S. Case no. 113 of (Mohit Kumar Shah, J) Amit/- U
