The petitioner in the present case is seeking anticipatory bail in connection with Sasaram (Nagar) P.S. Case No. 22 of 2019 registered for the offences punishable under Sections 341, 323, 384, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that in terms of the allegations, the petitioner was one of the members of the mob who had allegedly gone at the place of occurrence when the co-accused Rahul Yadav is said to have took out pistol from his pocket and fired upon the brother of the informant but that did not hit the brother of the informant and no injury was caused. It is further submitted that some of the co-accused has been granted anticipatory bail by a learned co-ordinate Bench of this Court in Cr. Misc. No. 41233 of 2019.

Learned APP for the State has opposed the prayer of anticipatory bail of the petitioner.

However, considering the facts and circumstances of the case where there are general and omnibus allegations and no overt act has been alleged against the petitioner, let the petitioner above named in the event of his arrest or surrender within a period of four weeks from today in connection with Sasaram (Nagar) P.S. Case No. 22 of 2019 be enlarged on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e. (i) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any
