====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and the State. Petitioner-Mukhiya is apprehending his arrest in connection with a case registered for the offence under Sections 467, 468, 471, 409 of the Indian Penal Code on the basis of the written report of the Investigating Officer of Bidupur P.S. Case No. 311 of 2007, which was registered on the basis of the statement of the petitioner alleging defalcation of funds by the Panchayat Secretary.

Panchayat Secretary produced few documents making out a case that whatever amount he has withdrawn, it is with the consent of petitioner. Signature of the petitioner on those documents has been sent for verification. It is submitted on behalf of the petitioner that till date no verification report has been received.

No.41401 of 2015 (2) dt.15-10-2015 2/2 The Director, Forensic Science Laboratory and the court below is directed to ensure that the report sought for in connection with the documents referred to above is submitted as early as possible, in any case, within four weeks from the date of receipt/ production of a copy of this order in the court below and thereafter the court below shall forward the order to the Director, Forensic Science Laboratory and until receipt of the report, no coercive steps be taken against the petitioner in connection with Bidupur P.S. Case No. 19 of 2012 pending in the court of Chief Judicial Magistrate, Vaishali.

It is made clear that once the report is received and petitioner's signature is matched with his signature on the documents then the court below shall pass appropriate order in the matter.
