2. In this case, the petitioner is seeking regular bail in connection with Beldaur P.S. Case No. 87 of 2024, registered for the offences punishable under Sections 30(A) and 30(F) of Bihar Prohibition and Excise Act.

3. As per allegation, three accused persons were arrested from a car wherefrom 97.2 liters of liquor was recovered. The driver became successful in fleeing away.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He was a passenger and was not aware with the illicit liquor, loaded in the dicky of that car. The petitioner is under

Patna High Court CR. MISC. No.45927 of 2024(2) dt.04-07-2024 2/2 custody since 31.03.2024 and he is a person of clean antecedent.

5. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Excise Court-II, Khagaria in connection with Beldaur P.S. Case No. 87 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) Before release of the petitioner, the learned court below shall verify his criminal antecedent and if it is found that he is involved in any other case except the present case, his bail bond shall be cancelled.
