2. The petitioners apprehend arrest in connection with Complaint Case No. 2326 of 2018, instituted for the offence punishable under Sections 420 and 406 of the Indian Penal Code.
3. The allegation is of giving Rs. 17,50,000/- to the husband of petitioner no. 2 by the complainant on the assurance of giving job in the Health Department.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.47664 of 2024(2) dt.07-08-2024 2/3 petitioners are innocent and they have been falsely implicated in this case. It is submitted that the alleged date of occurrence of abusing and attempt to assault is 02.12.2018 and this complaint case was filed on 11.12.2018, i.e., after delay of 9 days and no information was given to the police, which makes the story dated 02.12.2018 highly doubtful. It is submitted that the said amount had been taken in the year 2015 and the case has been lodged after the death of husband of the petitioner no. 2 on 29.05.2018. The petitioner no. 2 is a lady and she was appointed as A.N.M. in Primary Health Center on 21.09.2019 after death of her husband. So far other accused persons are concerned, the allegation against them is only of abusing and threatening. There is no specific allegation against the petitioners in this case. Lastly, it has been submitted that petitioner no. 2 has one criminal case and petitioner nos. 1 and 3 have no criminal case against them.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Complaint Case
Patna High Court CR. MISC. No.47664 of 2024(2) dt.07-08-2024 3/3 No. 2326 of 2018, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M.-Ist Class, Bettiah, West Champaran, subject to condition as laid down under Section 438(2) of the Cr.P.C..
