This criminal revision application has been filed against an order, dated 01.10.2016, passed in Criminal Appeal No. 103 of 2016, whereby learned Additional Sessions Judge I, East Champaran, at Motihari, has rejected the appeal preferred against an order, dated 22.07.2016, passed by the Juvenile Justice Board, East Champaran, at Motihari, in J.J.B. Trial No. 874 of 2016, arising out of Mehasi Police Station Case No. 05 of 2016. The petitioner is a juvenile and he is an accused in a case disclosing offence punishable under Sections 302/201/120B of the Indian Penal Code and Sections 3 (v)
Patna High Court CR. REV. No.1244 of 2016 (2) dt.25-01-2017 2/2 (x) of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act.
Learned Counsel for the petitioner has submitted that the petitioner is in custody since 10.02.2016 and the enquiry is yet to be concluded by the Juvenile Justice Board, East Champaran, at Motihari. Considering the facts and circumstances, I consider it appropriate to dispose of this application with a direction to the Juvenile Justice Board, East Champaran, at Motihari, to conclude the enquiry within a period of two months from the date of receipt/production of a copy of this order.
If the enquiry, under Section 14 Juvenile Justice (Care and Protection of Children) Act, 2015, is not completed by the Juvenile Justice Board, East Champaran, at Motihari, within the aforesaid period of two months, the petitioner shall be released forthwith on bail. This application stands disposed of with the direction, as above.
