JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-07-2019 This application, for grant of anticipatory bail, arises out of Mahila P.S. Case No. 25/2019, disclosing offences under Sections 323, 341, 498A, 504, 506/34 of the Indian Penal Code.
Petitioner happens to be husband of the informant and the allegation against him is of demand of dowry of Rs. Two Lakh and for which she was subjected to cruelty and torture and ultimately, she was ousted from the house and earlier also the informant has lodged a complain with Mahila Help Line. Submission of learned counsel for the petitioner is that he is still ready to keep her with full honour and dignity but the informant left the house on her own and further no specific allegation has been attributed to the petitioner so far demand or assault is concerned.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -Ist Class, Samastipur, in connection with Mahila P.S. Case No. 25/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Vinod Kumar Sinha, J) sunilkumar/- U T
