This is an application for grant of bail for offences punishable under Sections 302/201 of the Indian Penal Code. It is alleged in the written report that informant received news that a dead body is lying near Chamardiha Canal. He went there and found the dead body of a person aged 30 years in a ditch.
It is submitted by the learned counsel for the petitioner that name of the petitioner has transpired during investigation. Since the deceased had illicit relation with his shali, therefore, this petitioner had caused murder of the deceased. Petitioner is said to be cousin father-in-law of the deceased. He is
Patna High Court Cr.Misc. No.52370 of 2016 (3) dt.25-01-2017 2/2 not named in the F.I.R. Besides suspicion, as submitted, no overt act is alleged against the petitioner. Other co-accused have been granted bail vide Cr. Misc. no. 54775 of 2016 and Cr. Misc. no. 42579 of 2016.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- IV, Nalanda, Biharsharif, in connection with Rajgir P.S. Case no. 7 of 2016.
