Petitioner is languishing in judicial custody since 22.04.2017 in connection with Special (NDPS) Case No. 57 of 2017 arising out of Dhanarua P.S. Case No. 173 of 2017 for offences punishable under Sections 20 and 22 of the Narcotics Drugs and Psychotropic Act, 1985.

The prosecution case, as lodged by the police personnel is that on secret information, the police apprehended the petitioner and from his possession 700 gm. Ganja has been recovered. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent. Petitioner is a handicapped person and nothing has been recovered

Patna High Court Cr.Misc. No.35257 of 2017 (2) dt.17-08-2017 2/2 from his conscious possession and that seized Ganja is very much less than the commercial quantity and he has been falsely implicated in the aforesaid case. It is further submitted that chargesheet has already been submitted and there is no chance of tampering with the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.

Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Patna, in connection with Special (NDPS) Case No. 57 of 2017 arising out of Dhanarua P.S. Case No. 173 of 2017.
