This is an application for bail in connection with Hussainganj P.S.Case No. 190 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Petitioner is not named in the FIR and the case is under Section 302 of the IPC.

Submission of learned counsel for the petitioner is that he has been made accused on the basis of confessional statement of co-accused and the co-accused has been granted bail in Cr.Misc.No. 27928 of 2017, vide order dated 26.7.2017 by a coordinate Bench of this Court. Further submission is that petitioner is in custody since 21.9.2016 and the case of petitioner is better footing that that of co-accused, who has been granted bail.

Having heard both sides and in view of facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S.Case No. 190 of 2016, subject to the conditions that :- (i) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) petitioner shall co-operate in trial and appear in court on each and every date fixed and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
