The petitioner seeks bail in connection with Civil Line P.S.Case No.348 of 2017 registered under Sections 409, 420, 120(B)/34 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act.

Accusation is that the petitioner being Excise Inspector was engaged in selling the illicit Indian made foreign liquor taking the same from the seized godown with the help of Godown Manager, namely, Rajendra Prasad Gupta and one Rajesh Kumar and 13 cartoons were also recovered from the office of the petitioner.

Patna High Court Cr.Misc. No.46932 of 2017 (2) dt.06-10-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that, in fact, the seized cartoon of the Indian made foreign liquor was seized by the petitioner and kept in the office of the petitioner. But the petitioner has falsely been implicated in this case and he is in custody since 26.8.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the the Special Judge, Excise Act, Gaya, in connection with Civil Line P.S.Case No.348 of 2017.
