This is an application for bail in connection with Complaint Case No. C-2/366 of 2017/ 499 of 2017 lodged for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of 468 litres of Nepali wine and he was arrested by police on chase. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he was not arrested at the spot. Further submission is that he is in custody for two months having clean antecedent.

Heard learned APP also.

Having heard both sides and considering the aforesaid facts and circumstances and also considering the fact that huge quantity

Patna High Court Cr.Misc. No.35711 of 2017 (2) dt.08-08-2017 2/2 of wine has been recovered, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

However, petitioner may renew his prayer for bail either after framing of charge in this case or after completion of further two months in custody.
