Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 380 and other allied Sections of the Penal Code, Section 3(1)(X) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act. He is named in the First Information Report along with Yogendra Mistri, Gariban Mistri and the two have already been admitted to the privilege of bail in the event of arrest by another Bench of this Court under order No. 2 dated 07.08.2015 passed in Cr. Misc. No. 30458 of 2015 (Annexure-
Patna High Court Cr.Misc. No.41520 of 2015 (2) dt.16-10-2015 5). It is submitted on behalf of the petitioner that his case is on better footing than the case of Gariban Mistri.
Let petitioner, named above, surrender in the court below (A.C.J.M., Hilsa, Nalanda) within four weeks from the date of receipt/production of a copy of this order in the court below in connection with Hilsa P.S. Case No. 562/2014, thereafter he be allowed the same treatment as has been allowed to Gariban Mistri under order dated 07.08.2015 passed in Cr. Misc. No. 30458 of 2015 and the said order be treated as part of this order.
