2. The petitioner seeks bail in connection with Simraha P.S. Case No. 22 of 2024 registered for the offence punishable under Sections-8©, 21(b) of the N.D.P.S. Act.

3. As per allegation, nine bottles of cough syrup and 9.41 gms. Of smack was recovered from possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted that the drug recovered from below the pillow of the petitioner is less than commercial quantity. It has next been submitted that the

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, presently I am not inclined to grant bail to the petitioner and accordingly, the same is rejected.

7. However, the petitioner may renew his prayer for bail before the court below itself after framing of charge.

8. The learned Court below shall verify the criminal antecedent of the petitioner.
