The petitioner seeks bail in a case instituted for the offences under Section 392 of the Indian Penal Code. Prosecution case, in short, is that the accused persons including the petitioner snatched the watch of the informant and some articles of the informant including cash. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.5.2018 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Due to political rivalry, the petitioner has been made accused. The allegation made in the F.I.R. is denied. The motorcycle in question has not been
Patna High Court Cr.Misc. No.50412 of 2018(3) dt.14-09-2018 2/2 recovered from the possession of the petitioner rather the said motorcycle is alleged to have been recovered from the possession of one Md. Basik.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Amour P.S. Case No. 72 of 2018.
