Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection
Patna High Court CR. MISC. No.160 of 2021(2) dt.17-08-2021 2/3 with Jehanabad P.S. Case No. 182 of 2020, registered under Sections 147, 148, 149, 341, 323, 325, 307 and 319 of the Indian Penal Code.
The accusation is that informant, Rounak Kumar, is doing the job in Omkar Engicom Private Limited and the office is situated in the ground floor of Alok Apartment situated near the Jehanabad Court Station. On 20.03.2021, in the morning, informant, Rounak Kumar along with Chandrasen Kumar was present in his office. In the meantime, six persons named in the FIR including the petitioners and 15 to 20 unknown having lathi, rod and pistol in their hand came there saying that they are pet-man of Alok and on the order of Vijay Singh (petitioner no.1), Subham Kumar (petitioner no.4) gave iron rod blow causing injury at his head and Sourabh Kumar also started to cause assault to him through lathi. At that time, Mritunjay Kumar (petitioner no.3) fired 4 to 5 round through pistol but the informant saved himself anyhow.
Thereafter, they snatched his gold chain worth of Rs.80,000/- and Renu Kumari (petitioner no.2) took cash of Rs.20,000/- from his pocket. Learned counsel for the petitioners submits that, in fact, Vijay Kumar (petitioner no.

No.160 of 2021(2) dt.17-08-2021 3/3 the said Company but the land on which the apartment has been constructed is a Government land, due to that reason dispute arose in between Alok Kumar and the petitioner and only to give undue pressure, Alok Kumar, director of the said Company managed to lodge the present case with false allegation. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No. 182 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
