17-11-2021 Heard learned counsel for the parties.

Earlier, the bail petition of petitioner was rejected twice by this Court, vide orders annexed at Annexure- 1 series. On last occasion, vide order dated 06.10.2021, a report regarding stage of the trial was called for, which has been received and kept at flag 'R'. From perusal of the same, it appears that charges have already been framed and case is at the stage of prosecution evidence. It further appears that bailable warrant of arrest has also been issued against witnesses of this case, but uptillnow, no witness has adduced his / her evidence. However, counsel for the informant submits that summons have not been received by the witnesses and he undertakes to produce all the witnesses within six months.

No.54683 of 2021(3) dt.17-11-2021 2/2 Considering the progress of the trial as well as undertaking given by counsel for the informant that witnesses will be produced before the trial court, the bail petition of petitioner is rejected with direction to learned trial court to conclude the trial as early as possible, preferably; within a period of nine months from the date of receipt/production of copy of this order.
