This application is for grant of regular bail in connection with Sachiwalay P.S.Case No.32 of 2017 , registered for the offences punishable under Section 366(A) of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the minor girl of the informant.
Submission of the learned counsel for the petitioner is that the petitioner has been made accused in this case only on the basis of suspicion and as a matter of fact the girl has fled away along with the co-accused. The case diary shows that she was kidnapped by one Vinay Kumar. The petitioner is in custody for about six months.
Patna High Court Cr.Misc. No.34617 of 2017 (3) dt.06-09-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail and the materials shows that the girl was seen along with the petitioner and she is still traceless. Having heard both sides and in view of the fact that the girl is still traceless, I am not inclined to grant bail to the petitioner at this stage, however, if the girl is recovered, the petitioner may renew his prayer for bail.
With the aforesaid observation, this application is dismissed.
