JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-08-2016 Heard learned counsel for petitioners and learned counsel for the State.

Perused the report submitted by the learned Additional Sessions Judge-V, Danapur sent to this Court vide letter no.182 dated 26th July, 2016.

It would be evident from perusal of the report that though charges were framed against the accused persons of the case on 13th April, 2015, only two witnesses have been examined. Rest of the witnesses have not turned up before the court, despite issuance of dasti-summons and bailable warrant of arrest. In that view of the matter, the petitioners, namely, Ram Pravesh Yadav and Binesh Yadav, who are in custody since

Patna High Court Cr.Misc. No.27707 of 2016 (4) dt.17-08-2016 2/2 8.9.2014 and 4.8.2014 respectively and whose case is more or less identically situated to that of Sanjay Yadav who has already been granted bail by a Bench of this Court vide order dated 4.3.2016 passed in Cr. Misc. No.382 of 2015, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Danapur in connection with Sessions Trial No.15 of 2015 arising out of Dulhin Bazar P.S.Case No.90 of 2014.
