The petitioner apprehends his arrest in connection with CIII 282 of 2019 registered under Sections 30(a)/37(b) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has gifted the motorcycle in question to his son-in-law Mantu Kumar Gupta and the said Mantu Kumar Gupta along with co-accused Bablu Kumar were going to their relative's house but in the way during the checking of vehicle some scuffle took place between co-accused and the police, as a result of which, the petitioner

Patna High Court CR. MISC. No.52621 of 2021(2) dt.08-04-2022 2/2 has been made accused in the instant case. Further he submits that in the first information report, nothing has been alleged against this petitioner. Petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-IIcum-Special Judge, Excise, Siwan in connection with Complaint Case No. C-III 282 of 2019 subject to the condition as laid down under Section 438(2) of the Cr.
