Neither petitioner is named in the F.I.R. nor does anything appear to have been recovered from his conscious possession. Petitioner is in jail custody since 11.03.2016 but up till now, he has not been put on T.I.P.
No doubt, petitioner does have some criminal antecedent and he confessed his guilt and his confessional statement was recorded by the police but except the aforesaid confessional statement as well as criminal antecedent, there appears to be nothing against the petitioner.
