Petitioner is in custody in connection with Rahui (Baghan Bigha) P.S. Case No. 260 of 2018 for the offence under sections 420, 406/34 of the Indian Penal Code. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

Referring to prosecution case, learned counsel for the petitioner submits that allegation against this petitioner is that he has taken substantial amount as consideration money but he declined to transfer the land in favour of the informant. Learned counsel appearing on behalf of the informant submits that Money Suit is pending.

The Petitioner is in custody since 12.3.2019.

No.39148 of 2019(2) dt.26-06-2019 2/2 Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Rahui (Baghan Bigha) P.S. Case No. 260 of 2018 subject to the condition that petitioner shall not transfer any land without prior permission of the Court and will extend full cooperation in conclusion of the trial.
