2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Paliganj P.S. Case No. 43/2026 registered for the offences punishable under Sections 196, 299, 191(2), 191(3) and 190 of the BNS.

3. As per FIR, named co-accused persons alleged to open firing near to new mosque, to create terror amongst nearby residents.

4. It is submitted by learned counsel appearing on behalf of the petitioner that as per CCTV, co-accused Chintu Pandey and Daya Dubey were found seen open firing near new mosque and this petitioner was not visible in the CCTV along with other named co-accused persons. It is submitted that subsequently on the basis of confessional statement as made by

Patna High Court CR. MISC. No.40867 of 2026(2) dt.24-06-2026 2/2 apprehended co-accused persons namely Chintu Pandey and Adarsh Kumar in police custody the name of this petitioner transpired in the present case, without having any cogent material. Petitioner claimed clean antecedent.

5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as admittedly petitioner not appears visible in CCTV footage during occurrence, where his name implicated with the present occurrence of firing on the basis of suspicion arising out of confessional statement of apprehended co-accused persons, accordingly petitioner above-named, who is a man of clean antecedent in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Danapur, Patna/concerned Court, where the case is pending in connection with Paliganj P.S. Case No. 43/2026 , subject to the conditions as laid down under Section 482(2) of BNSS.
