The petitioner apprehends his arrest in connection with Sabour P.S. Case No. 20 of 2019 registered under Sections 323, 504 and 506 of the Indian Penal Code and Section 25(1-B), 26 and 35 of the Arms Act.

The accusation is that petitioner and Sanjeev Mandal boarding on motorcycle reached near the informant and started to abuse him. When the informant made protest then Sanjeev Mandal pointed the pistol and this petitioner pressed his neck. On raising alarm, neighbourers reached there and saved him. Thereafter, petitioner and Sanjeev Mandal started to flee away but the persons, who present there, snatched the pistol

Learned counsel for the petitioner submits that while the petitioner and Sanjeev Mandal were not apprehended at the spot but due to dirty village politics, petitioner and Sanjeev Mandal have falsely been implicated in this case. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Bhagalpur, in connection with Sabour P.S. Case No. 20 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
