The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

1746 liters of foreign liquor has been recovered from a container.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the said container and got no concern with the seized liquor. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent.

Considering the nature of allegation and clean

Patna High Court CR. MISC. No.42079 of 2022(2) dt.30-09-2022 2/2 antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge - II (Excise Act), Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 92 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
