The petitioners seek bail in a case registered for offences under Section 30 (A), 37(B) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 164 litres of foreign liquor were recovered from the Maruti Suzuki Alto Car which was being boarded by three persons including the petitioners. Petitioners claim that they are having clean antecedent and are in custody since 09.06.2017. Considering the facts and the circumstances of the

No.39229 of 2017(2) dt.19-08-2017 2/2 case, the petitioners, above named are directed to be released on bail on heir furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VI-cum-Special Judge, Excise Act, Kaimur at Bhabhua in connection with Ramgarh P.S. Case No. 136 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
