Petitioner is accused in connection with Khaira P.S. Case No. 252 of 2015 registered under Sections 395 of the I.P.C. and section 25 of the Antiquities and Treasure Act. Submission is that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has been surfaced in the confessional statement of co-accused Sailesh Kumar @ Lalan Paswan. Except the confessional statement, there is nothing against the petitioner to show his involvement in the present case. Further submission is that while the petitioner is accused in Goh P.S. Case No. 176 of 2015, in which also the name of the petitioner has come in the confessional statement of co-
Patna High Court Cr.Misc. No.29053 of 2016 (2) dt.20-07-2016 2/2 accused Rambilash Chaudhary, but in that case, his prayer for bail was allowed by a Bench of this Court vide Cr. Misc. No. 18945 of 2016 on 04.05.2016. It is also submitted that petitioner is in custody since 03.03.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Jamui in connection with Khaira P.S. Case No.252 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
