JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Raniganj P.S. Case No.235 of 2015 registered under Section 392/411 of the Indian Penal Code.

As per the prosecution case, four unknown miscreants are said to have looted the motorcycle of the informant. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. Nothing incriminating article has been recovered from his conscious physical possession. There is nothing in the case diary indicating the complicity of the petitioner in the occurrence barring the confessional statement of one coaccused, namely, Nitesh Kumar Singh who has been enlarged on

Patna High Court Cr.Misc. No.46087 of 2017 (02) dt.20-09-2017 2/ 2 bail by a co-ordinate Bench of this Court in Cr. Misc. No.15038 of 2016 vide order dated 18.05.2016. The petitioner has been languishing in custody since 20.07.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Araria in connection with Raniganj P.S. Case No.235 of 2015.
