Petitioner seeks bail, who is in custody since 01.11.2021 in connection with Town P.S. Case No. 613 of 2021, arising out of Sessions Trial No. 607 of 2022, F.I.R. dated 09.10.2021 registered for the offences punishable under Sections 366, 120(B), 354, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with with family members kidnapped the victim for the purpose of marriage or with evil intention.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.42151 of 2022(5) dt.17-04-2023 2/2 petitioner has clean antecedent and he has been falsely implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and no such occurrence had taken place.
Vide order dated 29.03.2023, a report was called for with regard to the stage of the trial. Report dated 06.04.2023 of the learned Trial court reveals that all the six chargesheeted witnesses including the informant have already been examined and discharged.
In view of the report of the learned Trial court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 607 of 2022 arising out of Town P.S. Case No. 613 of 2021 pending in the Court of learned 1st Additional Sessions Judge, Motihari, East Champaran.
Prayer is refused.
However, the learned Trial court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U T
