Petitioner prays for bail in connection with Goraul P.S.Case No. 92 of 2018 registered for the offences punishable under Sections 302, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation as per FIR is that two accused persons came on a motorcycle and fired on the informant, causing injury to him and they fled away and petitioner is not named in the FIR. Submission of learned counsel for the petitioner is he is not named in the FIR and later on his name transpires in confessional statement of co-accused and except that there is nothing against him and similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court vide order dated

Patna High Court Cr.Misc. No.48762 of 2018 (3) dt.09-10-2018 2/2 20.7.2018 passed in Cr.Misc.No. 42613 of 2018 and petitioner is in custody for more that five months.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Vaishali at Hajipur, in connection with Goraul P.S.Case No. 92 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
